Terms of Service

These Terms of Service (“Terms”) govern your use of the Dive Ledger mobile application (“App”) operated by Harsh Bhargava (“we”, “our”, “us”). By downloading, installing, or using Dive Ledger, you agree to these Terms. If you do not agree, do not use the App.
Account Terms
- You must be at least 13 years old (or 16 in the EEA) to use the App.
- You must provide accurate information when creating an account.
- You are responsible for maintaining the security of your account credentials.
- One person or legal entity may maintain no more than one account.
- You are responsible for all activity that occurs under your account.
Guest Mode
You may use the App without creating an account via guest mode. In guest mode:
- All data is stored locally on your device only
- Data is not backed up, synced, or recoverable if lost
- Social features (friend connections, buddy linking) are not available
- You are solely responsible for local data backups
We are not responsible for data loss in guest mode. You may upgrade to a full account at any time to enable cloud sync.
Subscriptions and Purchases
Plans
Dive Ledger offers a free tier with limited cloud sync and the following paid options:
- Monthly subscription: recurring billing each month
- Annual subscription: recurring billing each year
- Lifetime purchase: one-time payment for permanent access
- Day Pass: one-time payment for 24 hours of premium access
Current prices are displayed in the App at the time of purchase and may vary by region.
Auto-Renewal Terms
- Monthly and annual subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
- Your App Store or Google Play account will be charged for renewal within 24 hours prior to the end of the current period, at the same price.
- You can manage and cancel subscriptions at any time through your device's subscription settings (iOS: Settings > Apple ID > Subscriptions; Android: Google Play > Subscriptions).
- Any unused portion of a free trial period will be forfeited when you purchase a subscription.
Price Changes
We may change subscription prices. You will be notified in advance through the App Store or Google Play, and price changes will not affect your current billing period.
Refunds
All purchases are processed through Apple's App Store or Google Play. Refund requests must be directed to Apple or Google per their respective refund policies.
Acceptable Use
You agree not to:
- Use the App for any unlawful purpose
- Attempt to gain unauthorized access to our systems or other users' accounts
- Interfere with or disrupt the App or its infrastructure
- Reverse engineer, decompile, or disassemble the App
- Use the App to store or transmit malicious code
- Abuse social features (friend requests, QR codes) to harass or spam other users
- Misrepresent your identity or impersonate others
- Violate any applicable laws or regulations
Your Data
- You retain ownership of all dive data, photos, and content you create in the App.
- You grant us a limited, non-exclusive license to store, process, encrypt, and transmit your data solely to provide the App's functionality (cloud sync, data export, friend features).
- You can export your data at any time in UDDF, CSV, JSON, or PDF format.
- You can delete your account and all associated data at any time.

Social Features
- You may connect with other users via friend codes, QR codes, or email search (if you opt into discoverability).
- When you connect with another user, they can see your display name and profile photo.
- You can remove friend connections and disable email discoverability at any time.
- You are responsible for any content or information you share with other users through the App.
Intellectual Property
- The App, including its design, code, branding, and documentation, is owned by Harsh Bhargava.
- “Dive Ledger” and associated logos are trademarks of Harsh Bhargava.
- These Terms grant you a limited, non-transferable, revocable license to use the App on devices you own or control, solely for personal, non-commercial purposes.
Service Availability
- We provide the App on an “as is” and “as available” basis.
- We do not guarantee uninterrupted or error-free service.
- We may modify, suspend, or discontinue the App or any feature at any time with reasonable notice.
- We perform maintenance and updates that may temporarily affect availability.
- Cloud sync availability depends on internet connectivity and our third-party infrastructure providers.
Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Dive Ledger is a recreational dive logging tool. It is not a substitute for proper dive training, certified dive planning software, dive computers, or safety equipment. Do not rely on the App for dive safety decisions. Always follow your training agency's guidelines and use certified equipment for dive planning and execution.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, PERSONAL INJURY, OR PROPERTY DAMAGE, ARISING FROM YOUR USE OF THE APP.
Our total liability for any claims arising from or related to the App shall not exceed the amount you paid for the App in the twelve months preceding the claim.
Indemnification
You agree to indemnify and hold harmless Harsh Bhargava from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of a third party.
Account Termination
- You may delete your account at any time through Settings > Account & Sync > Delete Account.
- We may suspend or terminate your account if you violate these Terms.
- Upon termination, your cloud-synced data will be permanently deleted within 30 days.
Important: Deleting your account or uninstalling the App does not automatically cancel active subscriptions. You must cancel subscriptions separately through your device's subscription settings (iOS: Settings > Apple ID > Subscriptions; Android: Google Play > Subscriptions) to stop future billing.
Dispute Resolution
If you have a dispute with us regarding the App or these Terms:
- Contact us first at support@hdblabs.com to attempt informal resolution.
- If we cannot resolve the dispute informally within 30 days, either party may pursue binding arbitration under the rules of the American Arbitration Association, conducted in English in the State of California.
- You agree to resolve disputes on an individual basis. Class actions and class arbitrations are not permitted.
Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting updated Terms within the App and/or via email. Continued use of the App after changes constitutes acceptance of the new Terms. If you do not agree to updated Terms, you should stop using the App.
Apple-Specific Terms
The following terms apply when you download or use Dive Ledger through the Apple App Store:
- These Terms are between you and Harsh Bhargava only, not Apple. Harsh Bhargava, not Apple, is solely responsible for the App and its content.
- The license granted to you is limited to a non-transferable license to use the App on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms of Service.
- Apple has no obligation to provide any maintenance or support services for the App.
- In the event of any failure of the App to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
- Apple is not responsible for addressing any claims by you or any third party relating to the App, including product liability claims, any claim that the App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
- In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Harsh Bhargava, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of any such claim.
- You represent and warrant that you are not located in a country subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- You must comply with applicable third-party terms of agreement when using the App (e.g., your wireless data service agreement).
- Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
General Provisions
- Governing Law: These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
- Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App.
- Waiver: Failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
- Assignment: You may not assign or transfer these Terms without our prior written consent.
